HB 2660 - Tobacco Tax - This bill puts to a vote of the people a tax increase of 55 cents per pack on cigarettes.  Proponents claim that it will generate about $200 million in revenue without accounting for a decrease in smoking, but also claim it will decrease smoking.  This will lead to a budget shortfall that will inevitably result in a request (or a demand) by legislators for more taxes on something else in the near future.  It will also increase black market tobacco sales, which will increase crime and availability of tobacco to minors.  The bill passed both houses of the Legislature and will be a State Question on the November ballot.

 

SB 835 - Cockfighting Misdemeanor - Sen. Shurden's bill would reduce some of the penalties for cockfighting and related activities to misdemeanors.  After being amended a number of times to appease critics, the bill died in the House.

 

HB 2259 - Marriage Amendment to State Constitution - This bill was something completely different, until Senate Republicans used parliamentary procedure to amend it to a constitutional amendment to ban same-sex marriage.  Had Democrats tried a stunt like this, the GOP would be howling about dirty tricks.  As it is, politicians shouldn't be defining marriage at all, and any amendment about marriage in the state constitution, to ban, legalize, or anything else, should be opposed.  The amended measure passed both the House and Senate and will be a State Question on the ballot in the general election.

 

HB 2101 - Breastfeeding - This measure exempts breastfeeding from state obscenity laws, as well as exempting breast-feeding mothers from jury-duty, as well as stay-at-home mothers whose children are not enrolled in pre-kindergarten or early childhood education programs.  The Legislature approved this bill and Gov. Henry signed it into law on May 25th.

 

HB 2176 - Pseudophedrine - Cold tablets are now restricted, thanks to this prohibitionist legislation.  HB 2176 requires that purchasers of tablets containing pseudophedrine must show a photo ID and provide a signature, in an effort to reduce methamphetamine production.  Marijuana and other drugs are completely prohibited, but that hasn't slowed production of those substances at all, and even Gov. Henry admitted "HB 2176 will not erase the scourge of methamphetamine."  Prohibition doesn't work, but our Legislature is sticking with proven bad methods to deal with this problem by passing this law, which was signed by the Governor on April 6.

 

SB 1258 - Bans unconstitutional agreements - This bill would outlaw agreements by government entities in Oklahoma that violate the state constitution.  Anyone who thinks such legislation would be unnecessary is not familiar with Oklahoma politics.  Among the provisions would be that any affected government bodies not a party to agreements must be notified when they occur, allowing them a better opportunity to protect their citizens and eliminate back-room deals by political power-brokers.  The Senate and the House passed differing versions of the bill, but it died in conference.

 

HB 1899 - Requires Selective Service registration for Driver's Licenses - Males between 16 and 25 will be required to consent to registration for the draft in order to get a driver's license or state identification card, now that HB 1899 is law.  The draft is nothing short of involuntary servitude, and should be eradicated.  By passing this bill encouraging the Selective Service System, the House and Senate are supporting the despotic militarism of the worst dictators in history.  The Governor signed HB 1899 into law on April 22nd.

 

SB 1331 - 'Emergency' Wiretapping - Under this law, a judge can give oral authorization for wiretapping for a period of 24 hours.  The prosecutor would presumably have to justify the need.  If a prosecutor has to justify their actions, it cannot be that much more expedient to require a signature of a judge.  Written warrants are required for a reason, in order to protect the rights of individuals from unreasonable search and seizure.  This bill, passed by both houses of the Legislature and signed into law by Gov. Henry on May 11th, undermines these important Constitutional protections.

 

SB 1190 - DNA samples taken illegally can still be used - This measure by Sen. Wilkerson allows DNA samples acquired "in good faith" to be held in state genetic databases even though they were not obtained in compliance with the law.  No mention is made of who gets to determine what is in good faith.  Both houses of the Legislature passed this bill, which was signed by the Governor on April 6th, which should be remembered when a murderer or rapist is set free because they were caught using an illegal obtained DNA sample.

 

HB 2373 - Tire Plant subsidy - $5 million in taxpayer dollars will be given to Bridgestone/Firestone if they invest $50 million in their Oklahoma City plant, a plan where the tire manufacturer will "partner" with the state.  The state should not partner with any business or otherwise favor some businesses over others.  Eliminate the innumerable subsidies and other taxpayer funded privileges for business and cut state taxes by that amount, and the Oklahoma economic climate will be the most conducive to growth in the nation.  HB 2373 passed both the House and Senate and was signed by Gov. Henry on June 3rd.
